Terms of Use

These terms apply when you use the Nearby Drops app or website. Please read them. By creating an account you agree to them.

1. Who we are

Nearby Drops is operated by Break The Pattern LLC, 1309 Coffeen Avenue, STE 1200, Sheridan, Wyoming 82801, United States ("we", "us"). Contact: hello@nearbydrops.com.

2. What Nearby Drops does

Salons and other beauty and wellness businesses ("salons") post short-notice free appointments ("drops"), usually at a discount. You can request a drop and the salon decides whether to confirm it.

We only provide the platform. The treatment contract is between you and the salon. The salon is responsible for the treatment, its quality, its prices, hygiene, permits and any health questions. We are not a party to that contract.

3. Your account

  • You must be at least 16 years old.
  • Give correct details, especially your phone number, so the salon can reach you.
  • Keep access to your email and Apple ID secure. You are responsible for activity on your account.

4. Requesting and booking

  • Sending a request is free. You can cancel it in the app at no cost until the salon confirms.
  • Once the salon confirms, you have an appointment with that salon. If you can't make it, tell the salon as early as possible. The salon's own cancellation rules may apply.
  • If you repeatedly don't show up to confirmed appointments, we may limit or close your account.
  • A drop can be taken by someone else or removed by the salon at any time before it is confirmed for you.

5. Prices and payment

  • Nearby Drops is free for customers. We charge no booking fee.
  • You pay the drop price directly at the salon. The app does not take payments from customers.
  • Each drop shows the salon's regular price next to the drop price. Prices and discounts are set by the salon.

6. Salons

If you use Nearby Drops as a salon, these additional terms apply:

  • You must run a real, registered business and have the right to offer the services you post. We may verify your business, for example through your Google Maps listing, and may pause listings that we cannot verify.
  • Joining is free. For each drop that is booked through Nearby Drops we charge a fee of 15% of the drop price, plus VAT where applicable. We invoice once a month and collect by SEPA direct debit.
  • Regular prices you show must be your genuine prices. Drops must be real, available appointments.
  • You are responsible for your services, staff, prices, taxes, licences and hygiene, and for handling customer data you receive only for the booking.
  • If a payment fails and is not settled, we may pause your listing.
  • You can pause or close your listing at any time. Fees for drops already booked remain due.

7. Fair use

Don't misuse the service: no fake requests or listings, no harassment, no attempts to break or overload the app, and no scraping. We may remove content or suspend accounts that break these rules.

8. Availability

We work to keep Nearby Drops available but cannot guarantee that it is always online or error-free. Drops are offered by salons and we cannot guarantee that any particular drop will be available.

9. Liability

We are fully liable for damage caused intentionally or through gross negligence, and for injury to life, body or health. For slight negligence we are only liable for breach of essential obligations, limited to the typical, foreseeable damage. We are not liable for the treatments themselves, which are provided by the salons. Your statutory rights as a consumer are not affected.

10. Ending your account

You can delete your account at any time in the app. We may close accounts that break these terms, and tell you why.

11. Changes

We may update these terms, for example when we add features. We will tell you in the app before important changes take effect. If you keep using Nearby Drops after that, the new terms apply.

12. Law

Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you can bring claims in the courts there.
